What can we protect?

Determine what is considered a patentable invention is an extremely difficult and complicated. Statutes State Patent that "anything under the sun that was invented by man qualifies as patentable Simple. sufficient, but if you've noticed, there are hundreds of pages full of exceptions and details on the idea of patenting a result of this sentence. Dozens of remedies and Business patent court have arisen because of questions about the patentability because it has not and probably never will be completely is trapped.

Thus, defining what is patentable is not as clear as black and white. The invention can include a wide range of areas, life itself as the subject matter is the result of human intervention. The key is that living matter must be a product of "human ingenuity" and not only an object of natural origin, such as shrimp with his digestive tract removed. However, the change may even be the simple fact that living matter is simply isolated or purified. For example, pieces without DNA damage may be patentable, provided they have been sequenced. The PTO has decided that the act of isolating and sequencing a DNA strand is the result of human intervention. Currently debate, it is huge around the patentability of biotechnology-related "inventions" such as DNA. Is a piece of DNA really an invention at all? Or how about a micro-organism is going to degrade the oil? Is this an invention? Should it be?
